Terms of Service for FernandinaConnect & Amelia Steward

1. Introduction & Acceptance of Terms Welcome to FernandinaConnect.com ("the Service"). We provide a community information platform and specialized exterior asset maintenance services, branded as "Amelia Steward" ("the Steward Services"). By using our website or enrolling in a maintenance plan, you agree to these Terms.

2. Description of Services

  • Community Discovery: Aggregation of local events, clubs, and information.
  • Amelia Steward Services: Bi-weekly "Rev & Wipe" visits. This includes engine idling, battery cycling, basic salt-neutralization surface wipedowns, and visual reporting for boats, cars, and golf carts.

3. Asset Access & Authorization By enrolling in an Amelia Steward plan, you represent that you are the legal owner or authorized agent of the vehicles/vessels listed. You grant FernandinaConnect and its authorized contractors a limited license to:

  • Access the exterior of your property (driveway, garage, dock, or marina slip) at scheduled bi-weekly intervals.
  • Board the vessel or enter the vehicle solely for the purpose of starting engines, cycling electronics/AC, and performing visual inspections.
  • Capture and upload photographs of dashboards, gauges, and the exterior/interior conditions of the assets for reporting purposes.

4. Mechanical Disclaimer & Limitation of Liability

  • Not Professional Mechanics: Amelia Steward provides preventative care and visual stewardship, not professional mechanical repair, diagnostics, or comprehensive auto/marine detailing. Our "Rev & Wipe" service is intended to mitigate idle-related degradation but does not guarantee the mechanical longevity, functionality, or aesthetic perfection of any asset.
  • Pre-existing Conditions & Natural Degradation: FernandinaConnect is not liable for mechanical failures (e.g., seized engines, electrical shorts, dead batteries, dry rot, rust) that occur during or after our scheduled visits. Coastal degradation is a natural occurrence that we help mitigate, but cannot entirely prevent.
  • Battery/Electrical: While we verify that chargers are connected and check basic battery health, we are not responsible for battery failure, fires, or electrical damage resulting from the owner’s equipment, faulty wiring, or marina/shore power fluctuations.
  • Mold/Environmental: While we may run AC units or verify dehumidifiers to assist in moisture reduction, we do not guarantee the prevention of mold or mildew, which is an inherent risk of the Florida climate.

5. Customer Obligations

  • Active Insurance: You must maintain active, comprehensive insurance coverage on all vehicles, vessels, and property enrolled in our services. Our service is not a substitute for insurance.
  • Safe Access & Keys: You must provide functioning keys/fobs and ensure that our team has unobstructed access to the assets on the scheduled service day. If access is blocked (e.g., secured pets, locked gates, changed marina codes), the service visit is forfeited for that period without refund. We are not liable for lost or damaged keys unless caused by our gross negligence.
  • Functioning Equipment: Engines must have adequate fuel and be in general "start-ready" condition. We do not provide fuel delivery, mechanical diagnostics, or jump-start services as part of the standard subscription.

6. AI-Generated Content & Reporting Reports provided via the Service may utilize AI-assisted image recognition (e.g., reading engine hours or RPM gauges from photos). These AI-assisted transcriptions are for convenience and informational purposes only. Owners should manually verify critical asset status before operation.

7. Subscription, Payments, & Cancellation

  • Billing: Subscriptions are billed monthly in advance via Stripe.
  • Cancellation: You may cancel at any time via your account dashboard. No pro-rated refunds are provided for partial months.
  • Force Majeure & Storm Protocol: In the event of a severe weather event (e.g., named tropical storms or hurricanes), scheduled visits may be suspended for the safety of our staff. "First-Eyes" post-storm photos will be provided only when local authorities deem travel and dock access safe.

8. Indemnification You agree to defend, indemnify, and hold harmless FernandinaConnect, its owners, and contractors from any claims, damages, liabilities, or expenses (including attorney fees) arising from: (a) your breach of these terms; (b) damage to your assets or property not directly caused by our gross negligence or willful misconduct; or (c) third-party claims related to your property or assets.

9. Governing Law These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts located in Nassau County, Florida.
